NOTICE OF ENVIRONMENTAL AUTHORISATION FOR THE SHANGONI GATE DEVELOPMENT WITHIN THE KRUGER NATIONAL PARK, LIMPOPO PROVINCE.
Notice is hereby given in terms of the National Environmental Management Act (Act No 107 of 1998), as amended, that South African National Parks (SANParks) has received Environmental Authorisation from the Department of Environmental Affairs (DEA) for the construction of the Shangoni Gate Development within the Kruger National Park, Limpopo Province. The Environmental Authorisation for this project was granted by DEA on 05 September 2017 and received by Envirolution Consulting on 08 September 2017.
REASONS FOR DECISION
The DEA is satisfied, on the basis of information available to it and subject to compliance with the conditions contained in the environmental authorisation. In reaching its decision the DEA considered the following into consideration:
The listed activities as applied for in the amended application received on 12 July 2017.
The information contained in the final BAR dated July 2017.
Comments received from the National Department of Environmental Affairs: Directorate responsible for Protected Areas Planning, Legislation, Compliance and Monitoring, Greater Giyani Local Municipality, LIM 345 Local Municipality, SAHRA and various registered Interested and Affected Parties as included in the final BAR dated July 2017.
Mitigation measures as proposed in the final BAR and the EMPr.
The information contained in the specialist studies contained within the appendices of the final BAR dated July 2017.
A sufficient public participation was undertaken by the applicant has satisfied the minimum requirements as prescribed in the EIA Regulations, 2014, as amended, for public involvement.

In addition to the above, key factors considered by DEA in making the decision:
The need for the project aims to:
Provide the neighbouring areas and communities an easier access to the Kruger National Park.
The proposed development will provide much needed employment and business opportunities to the surrounding communities.
This development will stimulate socio-economic development among communities in the region.

thabang@envirolution.co.za. Interested and Affected Parties wishing to formally appeal must follow the procedure, in accordance with Chapter 2 of the National Appeal Regulations 2014 as follows:
Appeal Submission
1. (a) An appellant must submit an appeal to the Appeals Administrator, and a copy of the appeal to the applicant, any registered interested and affected party and any organ of state with interest within 20 days from:
(b) the date that the notification of the decision for an application for an environmental authorisation was sent to the registered interested and affected party by the applicant.
(c) the date that the notification of the decision was sent to the applicant by the competent authority, issuing authority, in the case decisions other those referred to in paragraph (a)
2. An appeal submission must be -
a) submitted in writing in the form obtainable from the appeal administrator: and
b) accompanied by –
(i) a statement setting out the grounds of appeal;
(ii) supporting documentation which is referred to in the appeal submission and;
(iii) a statement including supporting document, by the appellant to confirm compliance with regulation 4(1) of these regulations

Responding statement
3. The applicant, decision maker, interested and Affected Parties and Organ of State must submit their responding statement, if any, to the appeal authority and the appellant within 20 days from the date of receipt of the appeals submission.
