SANParks Mandate under Review?

Interesting tender document!
The successful bidder will be required to review SANParks’ Legislative mandate, which includes the following aspects:-
 The principle of what type of organisation is envisioned that can effectively deliver on the mandate and the 5-year strategy. The mandate must provide for all that SANParks aims to be (i.e. vision and mission) and needs to do.
 Clear delineation of SANParks’ responsibility and legal right to work outside of the boundaries of national parks; including that of Environmental Management Inspectors.
Are Chapters 4 and 5 of the NEMA clear, or is it necessary to include such provisions in NEM: PAA?
 Ensuring that the mandate adequately provides for law enforcement, environmental crime and special/forensic investigations by SANParks.
 Ensuring that the mandate adequately provides for Cultural Heritage.
 Providing a business case for reclassification of SANParks as a Public Entity in terms of the PFMA (Public Entity 3A vs 3B, or even schedule 2) taking into account that SANParks’ mandate has not been reviewed since 1994.
 Determine the applicability of King IV code and principles to SANParks and to what extent.
 The funding of conservation mandate and government obligation towards the mandate
 The mandate review within but also beyond legislation.
 The meaning and application of the legal framework in terms of which the Minister is able to assign any other conservation related issue to SANParks.
 The limitations directly related to the scope of the mandate review and possible rectification or correction to ensure a comprehensive review (what are the key challenges and fundamentals in SANPaks mandate and the review thereof).
 The roles played by SANParks’ partnership towards effective delivery on SANParks’ mandate and possible enhancement thereof.
 Outlining risks and opportunities of retaining the status quo or changing the current mandate
 Provision of a mechanism for the implementation of SANParks Tourism and Socioeconomic Transformation Strategies
 Ensuring that SANParks mandate provides for the evolution of sustainability and unfunded aspects of its mandate, including the decision making framework of such aspects.
 The link as well as alignment between SANParks mandate and the Shareholder’s Agreement.

They are trying to establish a "mandate" that will hold up in court when it is challenged that they do not do conservation but instead do fundraising for social development and political ends, or somesuch. It won't stand up to legal scrutiny either way, but it is a nervous step.

It is not right that Sanparks can change their mandate, vision and mission a.s.o. whenever they feel like it :evil:
