Ja, the question of intellectual property was largely laughed off years ago already, regarding random videos taken in SANParks, but SP have taken the position that they are owners of the parks, not the public worldwide, as has been abundantly illustrated in various commercial and political regards, so here we go re money... 0*\

AS PRWIN and PJL said, commercial filmmakers follow a different route, social media is uncharted territory! 0()

We got back from Kruger yesterday and have never seen the park so quiet. We drove the H4-1 one day and didn't see another car for an hour! :yes: We didn't experience any traffic jams - even at a leopard sighting on the H4-1 there were a few cars but nothing serious. We checked the sightings app a few times but there were very few 'tings'. We found that most sightings were passed from car to car, not via social media. -O-

Looking at social media, things are going to go public soon, IMO, regarding this whole intellectual property thing, and financial benefits accruing from "innocent" visitors posting videos to Youtube, that get sold without their knowledge. It is not confined to one website/app at all, a bit of a mess. But involves hundreds of thousands of Rands, I think?

AW management has full tabs on this, as we are approached, which is a great fillip! \O

’n Pensioentrekker van Margate eis R10 miljoen van ’n webblad wat ’n video wat sy in die Krugerwildtuin geneem het, sonder haar toestemming van YouTube “gesteel” het.

Joan Young (65) het in April 2013 ’n kort video met die titel “Small bird attacks snake” op dié internet-videokanaal gepubliseer.

Vroeër vanjaar het sy agtergekom dié video word gedeel deur ’n webblad en Facebook-groep, Latest Sightings, wat klaarblyklik daaruit geld maak. Latest Sightings het die video geredigeer en hul logo daarby gesit en verdien advertensie-inkomste daarmee.






Young sê toe ’n vriend haar van haar video op die webblad vertel, was sy geskok. Sy was 40 jaar betrokke by omgewingsnavorsing en onderwys.

Sy sê mense vra haar gereeld om van haar foto’s en video’s te deel. “Ek is nie ’n agterdogtige mens nie en het nog nooit gekyk waar my stories gedeel is en of dit reg gedoen is nie.

“Stories uit die natuur is maar deel van my lewe,” sê sy.

Dié geval is egter anders.

“Ek het niemand ooit toestemming gegee om my video’s te kopieer, te verander, advertensies daarop te sit of om dit onder ’n ander naam te bemark nie.”

Volgens Young se berekeninge beloop die verdienste wat Latestsightings.com uit dié video, asook drie van haar ander video’s gemaak het, heel waarskynlik meer as R10 miljoen.

Die stigter van die webblad, ­Nadav Ossendryver, het vroeër in korrespondensie teenoor Young beweer sy het twee jaar tevore toestemming gegee dat hy die video op sy webblad mag deel.

Luidens die webblad het Ossendryver, wat gek is oor die Kruger- wildtuin en die natuur, die webblad begin toe hy 15 jaar oud was.

Dit het uiteindelik gegroei tot ’n heeltydse onderneming waar wildtuin-entoesiaste hul foto’s en video’s kan oplaai en geld daarmee verdien. Volgens die webblad het ’n onlangse video van leeus wat ’n renoster aanval, bykans R14 000 verdien.

In ’n brief skryf Ossendryver in April aan haar: “Ek sal graag met jou in telefoniese kontak wil tree en praat oor hoe ons enige foute wat ek kon begaan het toe ek 16 jaar oud was, kan regmaak.”

Dieselfde dag nog het Corinne W. Ossendryver, ’n direkteur van die maatskappy, ’n formele, skriftelike aanbod gestuur. Young sê hulle het haar R34 504,70 – 40% van wat hulle blykbaar uit haar video verdien het – aangebied op twee voorwaardes: Sy moes op ’n openbare forum, soos Camps and Roads of Kruger, se Facebook-blad hulle van oortredings van haar kopiereg onthef. Sy mag ook nie die aanbod bekend maak nie.

“Ek het my vererg,” sê Young.

Op 21 April waarsku ’n ander direkteur van Latest Sightings, Paul Freinkel, in ’n brief haar dat sy haar woorde moet tel.

“As dit onder ons aandag kom dat jy op enige forum of aan enig­iemand enige uitlatings of beskuldigings teen ons maak, sal ons nie skroom om ons tot die hooggeregshof te wend nie, met ’n eis teen jou vir skade daardeur veroorsaak. Hierdie brief dien as formele kennisgewing dat ons regstappe sal doen met koste.”

Young is tot Maandag 25 April gegee om hul aanbod te oorweeg.

Sy het egter hul aanbod van die hand gewys en aangedring dat hulle die volle verdienste van haar video aan haar betaal.

Rapport verstaan daar is ander mense en instansies, soos Sanparke, wat eise teen Latests Sightings ingestel het, of dit oorweeg. Isaac Phaahla, woordvoerder van die Krugerwildtuin, het bevestig dat Sanparke dié week met hul prokureur vergader.

Ossendryver het nie op Rapport se navrae gereageer nie.

Does "Latest Sightings" sell their photos and video's? From the above it seems so. If an online magazine post a video with "Latest Sightings" written on it, they have paid for posting it, even if you can see it for free on youtube?
